$5.5 Million Medical Malpractice Verdict
(Fulton County, Georgia State Court, September 26, 2002) Robert J. Fleming successfully tried to verdict this medical malpractice case against a number of doctors. Defendants made no offer of settlement prior to trial. The client suffered partial loss of vision in her right eye after her blood levels were not properly monitored following surgery and administration of the blood-thinning medication, coumadin. After a two week trial, the jury awarded damages to the clients in the amount of $5,500,000. This was Mr. Fleming's first trial as lead counsel in a medical malpractice case.

$3.25 Million For Alleged Fraud in Sale of Business
(U.S. District Court--Northern District of Georgia) Mr. Fleming successfully represented the founders of an Indianapolis, Indiana medical office practice management company who sold their business to the defendant Atlanta company in exchange for stock in the defendant company. Shortly after the sale, and before Plaintiffs could sell their newly acquired shares, the defendant's stock price plummeted. Suit was filed in the Northern District of Georgia Federal Court alleging, among other things, breach of contract, and fraud and misleading statements by defendants during the sale negotiations. The case settled on the eve of trial for $3,250,000.

Confidential Settlement in Commission Pay Dispute
Mr. Fleming successfully represented a commissioned salesperson who sued his former employer to recover commissions owed to him. Just days prior to leaving the company, the salesperson closed a large sale. The sale was completed but not installed. Even though the sale was completed prior to the employee leaving, the company refused to pay the full amount of commissions owed. Suit was filed. During the early stages of litigation, the company was forced to produce the commission plan, which stated that the commission was earned upon completion of the sale. The case settled for a confidential amount shortly after suit was filed.

$1.9 Million Recovered in Pay Dispute
Mr. Fleming successfully represented a business consultant to a clothes manufacturer. The manufacturer hired the consultant and promised to pay him in corporate shares at a time when its shares were selling for about $1/share. The value of the promised shares at the time the parties entered into the consulting agreement was approximately $100,000. Shortly thereafter, the shares rose to over $23/share and the manufacturer refused to pay the consultant in shares, alleging that it was only bound to pay the consultant $100,000 (the value of the shares at the time of the contract). Suit was filed in California federal court and the case settled days before trial for over $1,900,000.

Confidential Settlement in Golf Cart Injury
Mr. Fleming successfully represented the Plaintiff who was injured when a well-known NFL football player ran into him with a golf cart during a Pro-Am event. The Plaintiff suffered a severe knee injury when the player rammed into him, wedging him between two golf carts. The case settled for a substantial but confidential amount.

$705,000 Verdict in Commission Dispute Case
Mr. Fleming successfully represented a real estate agent who sued a real estate developer who refused to pay her commissions that she had earned. The last offer of settlement by defendants prior to trial was $30,000. After a week-long trial, the jury returned a verdict in our favor in the amount of $705,000.

Confidential Settlement for Motorcycle Wreck
Mr. Fleming successfully represented the driver of a motorcycle who had been cut off by a negligent automobile driver. In this case, both vehicles were traveling in the same direction (with the motorcycle in the left lane and the automobile in the right lane). While traveling at approximately 50 miles per hour, the automobile attempted a left hand turn from the right lane, cutting off the motorcycle and sending the motorcycle up in the air and head first into a utility pole. Prior to filing suit, Mr. Fleming uncovered numerous layers of additional insurance and the case settled for a substantial but confidential amount.

Confidential Settlement for Premises Liability Accident
Mr. Fleming successfully represented an injured teenager and his parents for injuries the boy sustained when he fell down the stairwell shaft in a house that was under construction. In this case, the allegation of negligence was that applicable building codes required the stairwell to be barricaded by installing guardrails to prevent the exact injury which occurred. The boy was playing with friends in the house after dark, fell 15 feet down the stairwell and suffered a severe head injury. After filing suit, the case settled for a substantial but confidential amount.
