$5.5 Million Medical Malpractice Verdict
(Fulton County, Georgia State Court, September 26, 2002) Robert J. Fleming successfully tried to verdict this medical malpractice case against a number of doctors. Defendants made no offer of settlement prior to trial. The client suffered partial loss of vision in her right eye after her blood levels were not properly monitored following surgery and administration of the blood-thinning medication, coumadin. After a two week trial, the jury awarded damages to the clients in the amount of $5,500,000. This was Mr. Fleming's first trial as lead counsel in a medical malpractice case.
$3.25 Million for Alleged Fraud in Sale of Business
(U.S. District Court--Northern District of Georgia) Mr. Fleming successfully represented the founders of an Indianapolis, Indiana medical office practice management company who sold their business to the defendant Atlanta company in exchange for stock in the defendant company. Shortly after the sale, and before Plaintiffs could sell their newly acquired shares, the defendant's stock price plummeted. Suit was filed in the Northern District of Georgia Federal Court alleging, among other things, breach of contract, and fraud and misleading statements by defendants during the sale negotiations. The case settled on the eve of trial for $3,250,000.
$1.9 Million Recovered in Pay Dispute
Mr. Fleming successfully represented a business consultant to a clothes manufacturer. The manufacturer hired the consultant and promised to pay him in corporate shares at a time when its shares were selling for about $1/share. The value of the promised shares at the time the parties entered into the consulting agreement was approximately $100,000. Shortly thereafter, the shares rose to over $23/share and the manufacturer refused to pay the consultant in shares, alleging that it was only bound to pay the consultant $100,000 (the value of the shares at the time of the contract). Suit was filed in California federal court and the case settled days before trial for over $1,900,000.

$705,000 Verdict in Commission Dispute Case
Mr. Fleming successfully represented a real estate agent who sued a real estate developer who refused to pay her commissions that she had earned. The last offer of settlement by defendants prior to trial was $30,000. After a week-long trial, the jury returned a verdict in our favor in the amount of $705,000.
$340,000 Inferior Alveolar Dental Nerve Injury Settlement
Robert J. Fleming successfully represented an Atlanta area woman who was injured by dental malpractice in Georgia. The client suffered a permanent nerve injury when a dentist improperly installed a dental implant too deep in the lower jaw. The client underwent attempted corrective surgery which was not successful and she now suffers from permanent pain and numbness in her lower lip, chin and jaw with the pain radiating in her face.

Robert J. Fleming successfully represented the Estate of an insured against a large national insurance company for failure to timely pay claims under the policy. Claims were for breach of contract and bad faith on the part of the insurance company. Under the policy, the insurance company was obligated to pay for care and treatment related to a “dreaded disease.” Even though the insured contracted and was treated for this disease, the insurance company refused to resolve the claims timely and in good faith. The case settled shortly after the proper demand was made for payment and just before suit was to be filed.
$100,000 Settlement in Auto Accident Case
Robert J. Fleming successfully represented the passenger in a vehicle which was involved in a T-bone collision along the section of DeKalb Avenue in Atlanta which has reversible traffic lanes. In this case, both vehicles were traveling in the same direction and our client's vehicle was cut off when the other driver attempted to make a left hand turn from the outer right lane. The at-fault driver testified at the scene that she did not realize that the traffic in the lane to her immediate left was traveling in the same direction. The settlement amounts were collected from numerous insurance policies which provided for medical payments and uninsured motorists coverage.
$100,000 Settlement in Atlanta Dog Bite Case
Robert J. Fleming successfully represented a Gwinnett County woman who was attacked by two pit bulls while gardening in her yard. The woman suffered numerous deep wounds and scarring on her calf, leg and ankle which required scar revision treatments. The pit bulls were not properly restrained by the owner and had escaped from the owner's yard. Liability was established by proving that the owner did not comply with the applicable animal control laws. Prior to attacking our client, the pit bulls had attacked a small girl who lived down the road.

The client suffered a debilitating injury to her inferior alveolar nerve secondary to bone grafting/harvesting which was improperly performed by the oral surgeon. In addition, numerous faulty dental implants were placed in the client’s lower jaw. Another alleged act of malpractice was that the defendant dentist and oral surgeon were negligent because they unnecessarily subjected the client to an increased risk of lingual and inferior alveolar nerve injury by choosing an outdated and unnecessary procedure to harvest the bone. Just days prior to leaving the company, the salesperson closed a large sale. The sale was completed but not installed. Even though the sale was completed prior to the employee leaving, the company refused to pay the full amount of commissions owed. Suit was filed. During the early stages of litigation, the company was forced to produce the commission plan, which stated that the commission was earned upon completion of the sale. Mr. Fleming successfully represented the driver of a motorcycle who had been cut off by a negligent automobile driver. In this case, both vehicles were traveling in the same direction (with the motorcycle in the left lane and the automobile in the right lane). While traveling at approximately 50 miles per hour, the automobile attempted a left hand turn from the right lane, cutting off the motorcycle and sending the motorcycle up in the air and head first into a utility pole. Mr. Fleming successfully represented an injured teenager and his parents for injuries the boy sustained when he fell down the stairwell shaft in a house that was under construction. In this case, the allegation of negligence was that applicable building codes required the stairwell to be barricaded by installing guardrails to prevent the exact injury which occurred. The boy was playing with friends in the house after dark, fell 15 feet down the stairwell and suffered a severe head injury. Robert J. Fleming represented a 50 year-old woman who had taken blood pressure medication for approximately 30 years. For the past 7 years, a major pharmacy chain had filled her prescribed blood pressure medication. The pharmacy negligently gave the client the wrong blood pressure medication, which was twice her required dosage. Soon thereafter, she experienced a life threatening reaction and had to be rushed to the emergency room. Upon receiving the wrong medication, the client noticed that the medication given to her was a different color than her usual medication. Concerned, she spoke with the pharmacy technician about whether she had been given the wrong medication. Having been put on notice of the pharmacy’s serious mistake, the technician assured the client that the medication was indeed her correct dose. The technician stated that the color difference was due to a change in the manufacture (supplier) of the medication. Relying on the technician’s assurances, the client returned home and began taking --what in fact--was a double dose of her required medication. Within days, she was rushed to the hospital: her blood pressure had begun fluctuating, taking sharp declines; her throat had begun to tighten; and she had begun experiencing severe pain in her chest, as well as radiating pain throughout her left arm. Due to the pharmacy error, the client now suffers from emotional disturbances, such as panic, anxiety, and fear of taking any prescription medications. She constantly fears that somehow her dosage of medication is wrong and that she will be rushed to the hospital again, or worse, die. The case settled for a confidential amount following a demand letter to the pharmacy which outlined our case and the damages which would be sought at trial.
